Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you and Optymyse Ltd (“Company,” “we,” “our,” or “us”) governing your download, access to, and use of the Servicefront mobile application (“App”).
The App enables authorized users of HubSpot accounts to access and manage help desk and customer support tickets using mobile devices.
By downloading, installing, or using the App from the Apple App Store, you agree to these Terms. If you do not agree, you must not use the App.
1. Relationship With Apple
These Terms are concluded between you and the Company only, and not with Apple Inc. (“Apple”).
The Company, and not Apple, is solely responsible for:
- The App and its functionality
- Maintenance and support
- Product claims
- Legal and regulatory compliance
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Apple has no obligation to provide maintenance or support services for the App.
2. Independent Application
Servicefront is an independent application and is not affiliated with, endorsed by, or sponsored by HubSpot, Inc.
Use of HubSpot services remains subject to HubSpot’s own terms and policies.
An active HubSpot account is required for meaningful use of the App.
3. License Grant
Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control in accordance with Apple App Store Usage Rules.
The App is licensed, not sold.
You may not:
- Copy or distribute the App
- Reverse engineer except where permitted by law
- Lease, sublicense, or resell the App
- Circumvent technical safeguards
4. Eligibility and Organizational Authority
You must be at least 18 years old to use the App.
If you use the App on behalf of an organization, you represent that you are authorized to:
- Access the connected HubSpot account
- Bind that organization to these Terms
5. Accounts and Authentication
The App requires authentication through authorized third-party services including HubSpot.
You are responsible for:
- Maintaining credential confidentiality
- Device and user access control
- Activities occurring through authenticated sessions
You must promptly notify the Company of suspected unauthorized access.
6. Third-Party Services and Platform Dependency
The App relies on third-party platforms including HubSpot APIs.
By connecting your account, you authorize the Company to access and process authorized data solely to operate the App.
You acknowledge that functionality may be affected if third-party providers experience outages, modify APIs, restrict access, or suspend accounts.
The Company is not responsible for third-party service availability.
7. Customer Data Ownership
Help desk tickets, communications, and related information accessed through integrations (“Customer Data”) remain owned by you or your organization.
You are responsible for lawful authority to process Customer Data, compliance with applicable privacy laws, and security of devices accessing the App.
The Company processes Customer Data only to provide App functionality, maintain system security, and diagnose and improve reliability.
Customer Data is not sold.
8. Acceptable Use
You agree not to use the App unlawfully, attempt unauthorized access, interfere with infrastructure or security, introduce malware, or disrupt service availability.
The Company may suspend access where misuse or security risk is reasonably suspected.
9. Subscriptions and Payments
Certain features may require payment.
Where purchases occur through Apple, Apple processes billing, Apple subscription terms apply, and subscriptions renew automatically unless cancelled through Apple account settings.
Refunds are handled through Apple where required.
10. Maintenance, Updates, and Support
The Company provides App maintenance and support. Apple has no responsibility to provide support services.
Updates may be required to maintain functionality or security.

11. Intellectual Property
The App and all related technology, software, branding, and materials (excluding Customer Data) are owned by the Company or its licensors and protected by applicable intellectual property laws.
No ownership rights are transferred to you.
12. Service Availability
The Company uses commercially reasonable efforts to maintain App availability.
No guaranteed uptime commitment is provided unless agreed in a separate written SLA.
13. Security Responsibility Model
The Company is responsible for securing infrastructure under its control.
Customers remain responsible for HubSpot permissions, user management, and device security.
14. Artificial Intelligence and Data Usage
Customer Data is not sold, used for advertising profiling, or used to train generalized artificial intelligence models for external purposes.
Data processing occurs solely to operate, secure, and improve the App.
15. Disclaimer of Warranties
To the maximum extent permitted by law, the App is provided “as is” and “as available.”
The Company does not guarantee continuous or error-free operation.
16. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for indirect damages, loss of profits, loss of data, or interruptions caused by third-party services.
Aggregate liability shall not exceed fees paid during the twelve (12) months preceding the claim.
17. Product Claims
The Company, and not Apple, is responsible for addressing product liability, regulatory compliance, consumer protection, and intellectual property claims.
18. Privacy
Use of the App is subject to the Privacy Policy available at [Privacy Policy URL].
19. Data Protection (UK GDPR)
Customer acts as Data Controller. Company acts as Data Processor.
Processing is limited to ticket synchronization, security, and technical support.
20. Export Compliance
You agree not to use or export the App except as permitted under applicable export control laws.
21. Suspension and Termination
The Company may suspend or terminate access where Terms are violated, required by law, or security risk is present.
22. Governing Law
These Terms are governed by the laws of England and Wales.

24. Changes to Terms
The Company may update these Terms periodically. Continued use constitutes acceptance of revised Terms.
25. Entire Agreement
These Terms constitute the entire agreement governing use of the App.

If any provision is unenforceable, remaining provisions remain in effect.
27. Assignment
You may not assign these Terms without written consent. The Company may assign them in connection with a merger or acquisition.
